1) This document is an agreement between Erron Gralore & Richard Spina, a partnership hereinafter called "Manscapes," a virtual fine art photography gallery appearing at www.manscapes.com on the World Wide Web, and the party, hereinafter called "Artist," whose name, city of residence, social security number and email address are entered hereinbelow.

2) Manscapes will show and offer for sale selected work(s) (at its discretion) from images of said work(s) made available to it by Artist for

, beginning on the date entered hereinbelow, and continuing following the end of that period at the pleasure of the parties until either notifies the other in writing with at least three calendar months' notice of that party's wish to terminate the representation of any or all works.

3)  For purposes of the works represented under this agreement, the Artist's wholesale price shall be

of the retail sale price charged by Manscapes to a buyer, (not counting taxes, shipping or framing costs, if any).

4) The Artist agrees that Manscapes will act as his/her sole sales agent on the Internet for any and all works, images of which have been submitted to and accepted, published/exhibited by Manscapes through the term of this agreement and any extensions thereof. The Artist further agrees that should he/she be contacted directly by a patron of Manscapes (regardless of the geography of such patron's residence) during the period of this representation, that the Artist will not sell work directly to said patron during the representation term or for one year following the term of this agreement. At that time this agreement may be re-negotiated. The Artist further agrees to make his/her best good faith efforts to ensure that the retail prices set for his/her works under this agreement are not higher than those offered to the general public by some other representation (in any geography) or by the Artist him/herself.

5) For sales of work for which enlargement(s), printing or other preparation and shipping to a buyer is coordinated or performed by Manscapes staff, the costs of such services is to be deducted from any balances payable to Artist.

     5a) For sales of work requiring custom printing or other preparation by the Artist and/or shipment of a sold work or works to a client direct from the Artist, Manscapes will forward to the Artist full specifications of work(s) and sizes required, along with shipping instructions. The Artist agrees to make his/her best efforts to print (or otherwise prepare) and ship any such orders as specified (providing Manscapes with carrier tracking numbers promptly following shipment) within a period not to exceed

from his/her receipt of such order.

     5b) Should a patron arrange for a commissioned work as a result of being exposed through Manscapes to the work of the Artist, Manscapes will be compensated at the same rate as provided in paragraph 3 hereinabove.

6) Manscapes agrees to promote the Artist's work via the Internet (and other media at its discretion), to inform the Artist of all sales as soon as they take place, and to remit payment to the Artist (including an amount sufficient to cover specified packing, shipping and handling costs), no later than two weeks following final receipt by Manscapes of the purchase price (and proof of shipping in the form of a USPO or licensed common carrier's official tracking number). At Artist's option, Manscapes may accrue Artist's earnings from sales in an online accounting accesible to Artist, from which transfers or payments may be periodically requested by Artist.

     6b) In those cases where the Artist must advance significant sums for the manufacture, preparation, packing and shipment of an ordered work, (e.g., $200 or more), he or she may require a deposit equivalent to as much as 50% of the Artist's wholesale price for that work in order to begin said manufacture and preparation for shipment.

7) For purposes of catalog, promotion and exhibit, the Artist agrees to supply Manscapes with high quality reproductions of each work for which Artist seeks representation and exhibit.

8" X 10" pearl or matte surface prints are preferred for either black and white or color works. Electronic submission of .gif or .jpeg image files may also be acceptable under guidelines available at http://manscapes.com/sub_guides.html  One copy or digital file of each image is required, but additional "hard copies" may have the effect of increasing media coverage of the Artist's work in particular. High quality 35mm or 2 1/4 color transparencies of color or toned works are useful with glossy magazines, as well, though not required.

8) The Artist authorizes Manscapes to reproduce any and all of the images that The Artist submits in printed or electronic catalogs for the purpose of wider exhibition and sale - always taking care to associate such images with appropriate copyright warnings. Such authorization extends to any and all media and electronic forums to which Manscapes may provide such images for the purposes of the promotion of the Artist and his/her work offered for sale by Manscapes.

By the entry of the information required in the six titled fields below hereon, the Artist indicates his/her agreement to all of the terms and conditions herein stated:

A copy of the completed agreement, signifying Manscapes' provisional acceptance, will be sent to the email address entered above. A fully executed copy, including the signature of a Manscapes Partner, will be mailed to The Artist following review and approval of the terms requested by The Artist.
